Quantification of damages in tort requires a comprehensive knowledge of benefits paid/denied/terminated in a plaintiff’s Accident Benefits file. From the plaintiff-side perspective, to better understand your clients’ needs, you must have day-to-day knowledge and understanding on the status of the AB file – this includes questions such as:

  • Is the plaintiff receiving treatment? If not, is it due to lack of funding?
  • Have IMEs been completed? If so, what do the assessor opine and how does this affect funding and next steps?
  • Has catastrophic status been contemplated? How does this affect the overall value of the tort file? These questions and more will be covered in this lunch and learn session.
