The pandemic has forced the legal profession to change the way it operates, particularly in the areas of wills and estates law. The Smarter and Stronger Justice Act and Accelerating Access to Justice Act has introduced sweeping and significant legislative changes to the:
-Succession Law Reform Act (Section 16, Will no longer revoked by marriage, remote witnessing of wills, Section 17, 21.1 and 43.1)
-Children’s Law Reform Act (section 51.1 – increase the amount payable to parent to $35,000)
-Substitute Decisions Act (remote witnessing of POAs)
-virtual witnessing and commissioning of documents, under the Electronic Commerce Act
-Estates Act (the new Small Estates Certificate)
